We will respond to allegations of copyright infringement in accordance with the Digital Millennium Copyright Act (the "DMCA") or any other relevant intellectual property law.
1. HANDLING OF CLAIMS
Our responses may involve removing, blocking or disabling access to the allegedly infringing items, terminating the user's access to our platform, or implementing a combination of these measures.
If you believe that content accessible on our platform infringes your copyright, you may submit a notification. Such requests should only be submitted by the copyright holder or an agent authorized to act on their behalf.
All copyright infringement notifications and counter-notifications must be written in English. Notifications written in foreign languages may be considered non-compliant and ignored.
2. SUBMITTING A DMCA NOTICE
If you decide to request the removal of content, remember that you are initiating a legal procedure. Misuse of this process may result in the suspension of your account or other legal consequences.
The written notice (the "DMCA Notice") must include:
- Identification of the copyrighted work.
- Identification of the infringing content with the exact URLs of the photos/media. (Usernames alone are not sufficient).
- Your contact details (name, mailing address, phone, email).
- A statement that you believe in good faith that the use is not authorized.
- A statement under penalty of perjury certifying that you are the owner or an authorized agent.
- A physical or electronic signature (your full name).

3. COUNTER-NOTICE GUIDELINES
If your content was removed in error, send a counter-notification to support@discretevibes.com including:
- Your contact details and signature.
- Identification of the content and its URL before removal.
- A statement that you believe in good faith that the content was removed in error.
- Your consent to the jurisdiction of the appropriate court.
We will forward the notice to the complainant. The removed material may be restored after 10 to 14 business days, unless we receive a legal action filed against you.
4. REPEAT INFRINGEMENTS
We may terminate or disable the accounts of repeat infringers or those who repeatedly infringe intellectual property rights, at our sole discretion.
